terms of use

shkeffy.com, dashboard.shkeffy.com and the other shkeffy.com sites that link to these terms (the site) are run by shkeffy LLC (shkeffy, we, us). we run shkeffy network, which distributes creators' content to platforms like Spotify and shares the revenue with them, and we help creators with distribution and sponsorships.

by using the site you agree to these terms. if you do not agree, do not use the site. how we handle personal information is explained in our privacy policy.

the site lets you:

• read about shkeffy network, its creators, case studies and testimonials
• estimate what a YouTube channel could earn with our earnings estimator
• book a call with us
• contact us by email, WhatsApp or Discord
• apply for and use a shkeffy dashboard account

we give you a personal, limited, revocable right to use the site for these purposes. you do not get ownership of the site, its content or its software.

nothing on the site is an offer to work with you. visiting the site, using the estimator, applying, booking a call or contacting us does not make us your agent or representative, and we decide which creators and businesses we work with.

working with us is covered by the written agreement you sign with shkeffy LLC, such as a content license and revenue sharing agreement for Spotify, CTV or another platform, or a sponsorship agreement. if these terms and a signed agreement disagree, the signed agreement wins for everything it covers.

these terms never change what a signed agreement says about revenue, payments, licensing, distribution, liability or termination.

dashboard accounts are for approved creators, their authorized representatives and our team. you must be at least 18, or the age of majority where you live, and able to sign a binding agreement. if you sign up for a company, you confirm you are allowed to act for it.

give accurate information and keep it up to date.

keep your password private. if a creator lets a manager or team member use the dashboard, use the access tools we provide rather than sharing a password where you can.

if you think someone else has access to your account, email shawn@shkeffy.com right away.

you are responsible for what happens under your account, except for activity caused by a security failure on our side.

we can pause or close an account for fraud, abuse, a security risk, or a breach of these terms or a signed agreement. we can pause an account while we look into a possible security problem. when it is safe and lawful we will tell you why.

pausing or closing dashboard access does not end a signed creator agreement and does not cancel money already owed under it.

the estimator looks up your YouTube channel's public numbers, compares them with revenue we have measured across channels in our network, applies an assumed creator share, and shows an estimated monthly creator payout range in US dollars.

it is an estimate, not a quote, an offer, a promise or financial advice. it is not your channel's actual past earnings. real earnings depend on things we do not control, including:

• whether your content is eligible and approved on each platform
• platform policies and monetization programs, which can change
• advertiser demand, season and where your audience lives
• your catalog, how often you upload and how your show performs

the estimate does not include taxes or payment fees. results can change as our data and methods change. what you actually earn is set by your signed agreement.

do not rely on an estimate to make a financial decision. results shown in case studies and testimonials are examples, not what most creators should expect.

please do not:

• break the law or anyone's rights with the site
• submit someone else's email or channel without their permission
• send automated or bulk requests, scrape the site, get around rate limits, or overload our servers
• upload malware or try to break into the site, our servers or anyone's account
• pretend to be someone else, or claim a connection to us you do not have

you may share links to the site and use it in any way the law allows. other copying of the site's content needs our written permission.

when you use the estimator, book a call, apply or contact us, give accurate information and only information you have the right to share.

if you send us feedback or ideas, you let us use them without paying you. you keep any rights you already had in them. ordinary messages to us are not confidential unless a separate agreement says they are.

the site's design, text, software and logos belong to shkeffy or to whoever licensed them to us. the shkeffy name and logo are ours.

creators keep ownership of their own content. creator names, channel names, images and channel numbers appear on the site as each creator's agreement with us allows.

Spotify, YouTube, MSN, Roku, Prime Video, Tubi, Fire TV, Bilibili and other names and logos belong to their owners. we show them to describe where content can be distributed. showing them does not mean those companies endorse us, unless we say so.

if you think something on the site uses your name, image or work without permission, email shawn@shkeffy.com and we will look at it and remove it if needed.

the site links to and uses other services, such as YouTube, Discord, X, WhatsApp and Google (for analytics, fonts and calendar bookings). their own terms and privacy policies apply when you use them, and we are not responsible for them.

we may change, pause or remove any part of the site, including the estimator, at any time. the site can be down for maintenance, outages or problems with services we rely on, and we do not promise it will always be available or error free.

the site and its public tools are provided as is and as available. to the fullest extent the law allows, we make no promises about them, including that they are accurate, complete, secure or right for your purpose, and we disclaim all warranties, express or implied. this does not change any promise in a signed agreement.

to the fullest extent the law allows, shkeffy LLC and its owners, employees and agents are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, from your use of the site.

our total liability for all claims about the site is limited to US$100.

this section covers only the site. it does not apply to claims under a signed creator, distribution or sponsorship agreement, and it does not limit liability the law does not allow us to limit.

if someone else makes a claim against us because you broke the law, broke someone's rights or seriously broke these terms while using the site, you will cover our reasonable costs from that claim, including reasonable lawyer fees. we will tell you about the claim, and you can help defend it. we will not settle it in a way that admits fault for you without your OK.

you can stop using the site at any time. we can limit or end your access if you break these terms or put the site or other people at risk. sections that should continue after access ends, such as ownership, disclaimers, limits of liability and your responsibility, do.

the site is not for children under 13. dashboard accounts and creator agreements are for people who are at least 18, or the age of majority where they live.

these terms are governed by the laws of Texas, without regard to its conflict-of-law rules. disputes about these terms or the site go to the state or federal courts in Travis County, Texas, and you agree to those courts. this does not take away any right the law in your country or state gives you that cannot be waived.

disputes under a signed agreement follow that agreement.

if part of these terms cannot be enforced, the rest still applies. if we do not enforce something right away, we can still enforce it later. these terms are the whole agreement between you and us about using the site, but they do not replace any signed agreement. we can transfer these terms as part of a sale or reorganization of the business.

we may update these terms. the date at the top shows the current version. for significant changes we will tell account holders by email or in the dashboard before the change takes effect when we can. using the site after a change means you accept it.
